State Laws

State Cap: No statute. Virginia has no statewide limit on rent increases, and state law prohibits cities and counties from passing local rent control ordinances.

Notice Period: For month-to-month tenancies, rent adjustments is included in the statutory timeline for modifying or ending a periodic agreement, which requires at least 30 days‘ advance written notice (Va. Code § 55.1-1253(A)). For lease renewals offered by landlords who own more than four rental units, state law requires at least 60 days‘ written notice before the lease term ends (Va. Code § 55.1-1204(K)). On fixed-term leases, landlords cannot raise rent prior to lease expiration unless explicitly permitted by the contract.

Proof of Service: Notice must be delivered in writing (Va. Code § 55.1-1202). Legal service across Virginia is established by personal hand delivery to the tenant, regular first-class mail (with a certificate of mailing), certified mail, or posting the notice at the primary entrance of the residence (Va. Code § 55.1-1202).

Prohibited Acts: Landlords cannot raise rent in retaliation against a tenant for reporting health or housing code violations, complaining about habitability issues, or joining a tenant organization (Va. Code § 55.1-1258). Rent increases are also illegal if done for discriminatory reasons under the Virginia Fair Housing Law (Va. Code § 36-96.3).
