State Laws

State Cap: No statute. Hawaii has no statewide statutory limit on rent increase amounts, and no local jurisdictions have enacted municipal rent control (§ 521-21(a)).

Notice Period: At least 45 days‘ written notice before the effective date for month-to-month tenancies (§ 521-21(d)). For tenancies of less than one month (e.g., week-to-week), landlords must provide at least 15 days‘ advance written notice (§ 521-21(e)). For fixed-term leases, landlords cannot increase rent during the active lease period unless expressly permitted by an escalation clause in the rental agreement (§ 521-21(b)).

Proof of Service: Landlords must deliver written notice by personal in-hand delivery or by delivering it to the tenant’s residence or designated address for receiving communications (§ 521-9(c)). Delivery is legally effective when dropped at the designated location or when the tenant actually receives it (§ 521-9(c)).

Prohibited Acts: Landlords cannot increase rent as retaliation against tenants for reporting housing code violations, joining a tenant organization, or exercising statutory rights (§ 521-74), for discriminatory reasons under fair housing laws (§ 515-3), or by raising prices during a declared state of emergency (§ 127A-30).
