State Laws

State Cap: No statute. South Carolina imposes no limit on rent increases, and local governments cannot impose rent control ordinances (§ 27-39-60).

Notice Period: 7 days‘ notice for week-to-week tenancies, and 30 days‘ notice for month-to-month leases (§ 27-40-770(a)-(b)).

Proof of Service: Notice must be delivered in writing by personal in-hand delivery to the tenant or by registered or certified mail to the address designated by the tenant (or last known residence); statutory proof of mailing constitutes valid notice without requiring proof of receipt (§ 27-40-240).

Prohibited Acts: Landlords cannot rent as retaliation against tenants for complaining to a government housing agency, complaining to the landlord about code or habitability violations, or organizing/joining a tenant organization (§ 27-40-910). Rent adjustments are also prohibited for discriminatory reasons under the South Carolina Fair Housing Law (§ 31-21-40).
