State Laws

State Cap: No statute. Montana has no statewide limit on rent increase amounts, and local government entities are statutorily preempted from enacting municipal rent control ordinances (Title 70, Ch. 24).

Notice Period: Landlords must provide at least 30 days‘ advance written notice prior to the effective date of the change for month-to-month tenancies (§ 70-24-441(2)).

Proof of Service: Notice must be delivered in writing (§ 70-24-441(2)). Service is legally established by hand-delivering the notice directly to the tenant, mailing it to their place of residence, or transmitting it electronically if the tenant voluntarily authorized email notification in the rental agreement (§ 70-24-108).

Prohibited Acts: Landlords cannot increase rent as retaliation against tenants for complaining about health or habitability code violations, joining a tenant organization, or enforcing statutory rights (§ 70-24-431), or for discriminatory reasons under the Montana Human Rights Act (§ 49-2-305).
