State Laws

State Cap: No statute. Florida has no statewide limit on rent increase amounts, and local governments are statutorily prohibited from enacting municipal rent control (§ 166.043(1)).

Notice Period: At least 30 days before the end of the monthly period for month-to-month tenancies, or at least 60 days before the end of any annual period for year-to-year tenancies (§ 83.57(1)-(3)). For fixed-term leases requiring notice of non-renewal or rent adjustment, landlords must adhere to the written notice window specified in the lease, up to a 60-day maximum (§ 83.575(1)).

Proof of Service: Landlords must deliver written notice by in-hand personal delivery, by mail, or by leaving a copy at the residence if the tenant is absent (§ 83.56(4); § 83.57). Electronic delivery by email is permitted only if both parties have signed a written addendum consenting to electronic notices (§ 83.505).

Prohibited Acts: Landlords cannot increase rent as retaliation against tenants for reporting housing violations, joining a tenants’ organization, or exercising statutory rights (§ 83.64), for discriminatory reasons under fair housing laws (§ 760.23), or through unconscionable price gouging during a declared state of emergency (§ 501.160).
