Month-to-Month Laws

Termination Notice – The landlord or tenant must give 60 days’ notice to terminate. The notice must be in writing, and the 60-day notice period starts on the first day of the month after the notice is given (§ 5106(d)).

Increasing Rent – Delaware law requires landlords to give 60 days’ notice before increasing rent for month-to-month leases. The notice must state the new rent amount and when the change will take effect (§ 5107(a)).
