State Laws
State Cap: No statute. Wisconsin has no statewide limit on rent increases, and state law prohibits local cities and municipalities from passing local rent control ordinances (Wis. Stat. § 66.1015).
Notice Period: For month-to-month tenancies, rent adjustments require at least 28 days‘ advance written notice before the end of the rental period (Wis. Stat. § 704.19(3)). On fixed-term leases, landlords cannot raise rent prior to lease expiration unless explicitly allowed by the contract.
Proof of Service: Notice must be delivered in writing (Wis. Stat. § 704.19(2)). Legal service under Wisconsin law is established by handing notice directly to the tenant, leaving a copy with someone in charge of the property and mailing a copy, sending notice by certified or registered mail, or posting it conspicuously on the property and mailing a copy (Wis. Stat. § 704.21(1)).
Prohibited Acts: Landlords cannot raise rent in retaliation against a tenant for reporting housing code violations, exercising legal rights, or contacting housing officials (Wis. Stat. § 704.45; Wis. Admin. Code ATCP § 134.09(5)). Rent increases are also illegal if done for discriminatory reasons under the Wisconsin Open Housing Law (Wis. Stat. § 106.50).
