State Laws

State Cap: No statute. South Dakota imposes no statewide limit on rent increase amounts, and municipalities are prohibited from enacting local rent control ordinances (SDCL § 6-1-13).

Notice Period: Landlords must provide at least 30 days‘ advance written notice before the end of the month to change any lease terms, including raising rent (SDCL § 43-32-13). For tenancies with unspecified terms, notice equal to the hiring term (not exceeding one month) is required (SDCL § 43-32-15). On fixed-term leases, rent increases prior to lease expiration are not permitted unless explicitly specified by the contract.

Proof of Service: Notice must be delivered in writing (SDCL § 43-32-13). Legal service across South Dakota is established by personal in-hand delivery or standard first-class mail addressed to the tenant at the leased property.

Prohibited Acts: Landlords cannot increase rent as retaliation against tenants for exercising statutory rights or reporting health and safety violations (SDCL § 43-32-27; SDCL § 43-32-28), nor for discriminatory reasons under state fair housing laws (SDCL § 20-13-20).
