State Laws

State Cap: No statute. New Hampshire has no statewide limit on rent increase amounts, and local municipalities do not have statutory authority to enact municipal rent control ordinances.

Notice Period: Landlords must provide at least 30 days‘ advance written notice prior to the effective date of the rent increase for month-to-month tenancies (RSA 540:2(IV)).

Proof of Service: Notice must be delivered in writing (RSA 540:2(IV)). Delivery is legally established either by certified mail or through statutory notice service procedures, which permit personal in-hand delivery directly to the tenant or leaving a copy at the tenant’s last and usual place of abode (RSA 540:2(IV); RSA 540:5).

Prohibited Acts: Landlords cannot increase rent as retaliation against tenants for reporting housing, health, or building code violations, joining or organizing a tenant union, or enforcing statutory tenant rights (RSA 540:13-a), or for discriminatory reasons under the New Hampshire Law Against Discrimination (RSA 354-A:10).
