State Laws
State Cap: No statute. Minnesota has no statewide limit on rent increase amounts, though local municipalities are permitted to enact municipal rent control ordinances if approved by voters in a general election, as in St. Paul (§ 471.9996).
Notice Period: For month-to-month tenancies, landlords must provide advance written notice equal to at least the interval between rent payment dates (typically one full rental period) before the increase takes effect (§ 504B.135(a)). Additionally, state law prohibits landlords from enforcing a rent increase notice period that is shorter than the notice period required for a tenant’s notice to quit (§ 504B.147).
Proof of Service: Notice must be delivered in writing (§ 504B.135(a)). Service is typically established by personal in-hand delivery or by sending a copy via first-class mail to the tenant’s residence.
Prohibited Acts: Landlords cannot increase rent as retaliation against tenants for reporting health or housing code violations, organizing with other tenants, or asserting statutory rights (§ 504B.285, Subd. 2), or for discriminatory reasons under the Minnesota Human Rights Act (§ 363A.09).
