State Laws
State Cap: No statute. Indiana has no statewide limit on rent increases, and local municipalities are statutorily preempted from enacting local rent control (§ 32-31-1-20).
Notice Period: At least 30 days before a rent increase takes effect on a month-to-month lease, unless the written agreement specifies a different notice period (§ 32-31-5-4).
Proof of Service: Notice must be in writing and delivered directly to the tenant (§ 32-31-1-1). If the tenant cannot be found, notice may be served by delivering a copy to a person residing at the premises and explaining the contents (§ 32-31-1-9).
Prohibited Acts: Landlords cannot increase rent as retaliation against tenants for reporting health or housing code violations, requesting repairs, or exercising legal rights (§ 32-31-8.5-2), or for discriminatory reasons under the Indiana Fair Housing Act (§ 22-9.5-5-1).
