State Laws

State Cap: No statute. No limit on how much the landlord can increase the monthly rent.

Notice Period: 30 days (recommended). There are no statutory rules specific to increasing rent. Therefore, the landlord is effectively terminating the lease, and the month-to-month rules are enforced, which is at least 30 days from the next payment date. (AS 34.03.290(b))

Proof of Service: Written notice is required and can be delivered personally, posted on the residence’s door, or sent by registered or certified mail. If mailed, add 3 days to the notice date and keep a record of service. (AS 09.45.100(c), AS 09.45.105, AS 09.45.090(c))

Prohibited Acts: The landlord is forbidden to increase the rent for any of the following retaliatory reasons:

  • Tenant complained to the landlord about a repair or other utility;
  • Tenant enforced their statutory rights under Alaska or local law;
  • Tenant organized to become a tenant’s union or similar organization;
  • Tenant made a formal complaint to a government agency. (AS 34.03.310(a))
