Month-to-Month Laws

  • Termination Notice: Landlords and tenants must each give 30 days’ notice before terminating the lease (§ 735 ILCS 5/9-207(b)). In Chicago, landlord-initiated terminations for month-to-month tenancies scale by tenancy length: 30 days (under 6 months), 60 days (6 months to 3 years), and 120 days (over 3 years) (MCC § 5-12-130(j)).
  • Increasing Rent: Statewide, landlords must give at least 30 days’ notice before raising rent on a month-to-month lease (§ 735 ILCS 5/9-207(b)). In Chicago, rent increase notices follow the same tiered tenure timeline (30, 60, or 120 days) as lease terminations (MCC § 5-12-130(j)).
